Terms and Conditions

(North Carolina)

By hiring Green Waves Home Services (“Company,” “we,” “us,” or “our”), the customer (“Client,” “you,” or “your”) agrees to the following Terms and Conditions.

1. Scope of Work

Green Waves Home Services provides landscaping, lawn care, exterior cleaning, seasonal maintenance, home services, and small construction services as outlined in the written estimate, proposal, or service agreement. Any services not specifically listed are not included unless approved in writing by both parties.

2. Estimates & Pricing

All estimates are based on visible conditions at the time of inspection. Prices may change due to unforeseen conditions, including but not limited to hidden damage, underground obstacles, code requirements, material price increases, or additional labor. Any changes will be communicated and approved before work continues.

3. Payment Terms

• Payment terms are outlined in the estimate or invoice.

• Payment is due upon completion of services unless otherwise agreed to in writing.

• Deposits may be required for larger or custom projects.

• Late payments may be subject to additional fees.

• Green Waves Home Services reserves the right to suspend or terminate services for non-payment.

4. Right to Lien (North Carolina)

In accordance with North Carolina law, Green Waves Home Services reserves the right to file a mechanic’s lien or pursue all legal remedies available for non-payment of services, labor, or materials provided.

5. Cancellations & Rescheduling

• A minimum of 24 hours’ notice is required to cancel or reschedule services.

• Cancellations with less than 24 hours’ notice may result in a cancellation fee.

• Weather or unsafe conditions may require rescheduling without penalty.

6. Access to Property

The Client agrees to provide safe and unobstructed access to the property, including securing pets, unlocking gates, marking utilities when required, and removing personal items from work areas. Delays caused by lack of access may result in additional charges.

7. Property Conditions & Damage Disclaimer

Green Waves Home Services is not responsible for damage caused by pre-existing or hidden conditions, including but not limited to:

• Unmarked underground utilities

• Irrigation systems

• Hidden roots, rocks, or debris

• Drainage issues

• Structural or soil instability

Landscaping and construction services involve inherent risks. Reasonable care will be taken at all times.

8. Landscaping & Lawn Care Disclaimer

Results depend on natural conditions such as weather, soil health, pests, and existing lawn or plant conditions. We do not guarantee specific growth results, weed elimination, or turf performance unless expressly stated in writing.

9. Materials & Plant Warranty

• Materials and plants are subject only to manufacturer or supplier warranties.

• Plant survival is not guaranteed unless a written warranty is provided.

• Improper watering, neglect, extreme weather, pests, or disease void any plant warranty.

10. Change Orders

Any changes requested after work begins must be approved in writing and may result in additional costs and extended timelines.

11. Subcontractors & Independent Contractors

Green Waves Home Services may utilize subcontractors or independent contractors to perform services. All work performed remains subject to these Terms and Conditions.

12. Safety & Liability

The Client agrees to keep children, pets, and unauthorized individuals away from work areas. Green Waves Home Services is not responsible for injuries resulting from failure to follow safety instructions or entering restricted work zones.

13. Insurance

Green Waves Home Services maintains appropriate insurance coverage as required under North Carolina law. Proof of insurance may be provided upon request.

14. Limitation of Liability

To the fullest extent permitted by North Carolina law, Green Waves Home Services shall not be liable for indirect, incidental, or consequential damages. Total liability shall not exceed the amount paid for the services provided.

15. Termination of Services

We reserve the right to terminate services if unsafe conditions exist, payment terms are violated, or the Client breaches these Terms and Conditions.

16. Governing Law & Venue

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of North Carolina. Any legal action shall be brought in a court of competent jurisdiction within North Carolina.

17. Acceptance

Approval of an estimate, scheduling services, or allowing work to begin constitutes acceptance of these Terms and Conditions.
